CONDITIONS GENERALES D’UTILISATION (CGU)
Les présentes CONDITIONS GENERALES D’UTILISATION conclues avec les UTILISATEURS, ont pour objet de fixer les dispositions contractuelles relatives aux droits et obligations de chacun dans le cadre de l’utilisation de nos SERVICES.
DERNIÈRE MISE À JOUR DE CE DOCUMENT: LE 30 Novembre 2021.
TOUTE UTILISATION EFFECTUEE A QUEL QUE TITRE QUE CE SOIT DE LA PLATEFORME IMPLIQUE OBLIGATOIREMENT L'ACCEPTATION SANS RESERVE, PAR L’UTILISATEUR, DES PRESENTES CONDITIONS GENERALES D’UTILISATION (CGU).
ARTICLE 1. INFORMATIONS LEGALES
La plateforme EION est éditée par la société EION, Société par actions simplifiée, immatriculée au Registre du Commerce et des Sociétés de Paris sous le numéro 803 693 118, dont le siège social est sis 5, rue Legouvé, 75010 Paris (ci-après « EION » ou « l’OPERATEUR »).
ARTICLE 2. DEFINITIONS
Les termes, mentionnés ci-dessous, ont dans les présentes CONDITIONS GENERALES D’UTILISATION, la signification suivante :
« COLLAB » : désigne la possibilité pour l’UTILISATEUR d’inviter un autre UTILISATEUR pour la création d’un CONTENU.
« COLLAGE » : désigne la possibilité pour un UTILISATEUR de coller deux photos pour la création d’un CONTENU unique.
« COLLECTION » : désigne le rassemblement de différents contenus organisés par l’UTILISATEUR. La COLLECTION peut être publique ou privée.
« COMPTE » : désigne l’interface hébergée sur la PLATEFORME dans laquelle est regroupé l’ensemble des données fournies par l’UTILISATEUR. L’accès au COMPTE se fait grâce aux IDENTIFIANTS.
« COMPO » : désigne la possibilité pour un UTILISATEUR d’accoler deux ou plusieurs photos pour la création d’un CONTENU
« CONDITIONS GENERALES D’UTILISATION » ou « CGU » : désigne les présentes conditions contractuelles mises à disposition sur la page d’accueil de la PLATEFORME, afin d’encadrer l’utilisation de celle-ci par tout UTILISATEUR.
« CONTENU » : désigne l’ensemble des photographies, et textes publiés par les UTILISATEURS sur la PLATEFORME.
« EVENT » : désigne un groupe organisé autour d’un évènement et ayant une date de début et une date de fin.
« GROUPES » : désigne un ensemble de publication de CONTENUS regroupé autour d’un thème.
« IDENTIFIANTS » : désigne l’adresse email et le mot de passe renseignés par l’UTILISATEUR lors de la création de son COMPTE, nécessaires à l’accès à son COMPTE sur la PLATEFORME.
« PLATEFORME » : désigne la PLATEFORME internet accessible à l’adresse https://www.eion.io et application mobile téléchargeable sur l’Apple Store. La PLATEFORME regroupe l’ensemble des pages web, services et fonctionnalités proposés aux UTILISATEURS.
« PLAYLIST » : désigne un ensemble d’image rassemblées autour d’un même thème et organisées, ajoutées ou supprimées par les ADMINISTRATEURS, auxquelles un UTILISATEUR choisi de s’abonner. La Playlist « Discover and explore EION » désigne un ensemble d’image organisées, ajoutées ou supprimées par les ADMINISTRATEURS en fonction de la qualité des images et leur diversité, sans rapport avec un thème particulier et à laquelle tous les UTILISATEURS sont abonnés.
« PROFIL » : désigne l’interface publique du COMPTE d’un UTILISATEUR
« SERVICES » : désigne l’ensemble des services proposés par EION aux UTILISATEURS par l’intermédiaire de la PLATEFORME, et notamment :
- La mise en relation des UTILISATEURS entre eux ;
- Des portfolios ;
- Une caméra ;
- Une photothèque.
« STREAM » : désigne l’interface rassemblant l’ensemble des CONTENUS publiés associant images et textes. Le STREAM peut être rattaché à un PROFIL, un GROUPE ou un EVENEMENT.
« UTILISATEUR » : désigne toute personne qui accède et navigue sur la PLATEFORME après s’être créée un COMPTE.
« SPECTATEUR » : désigne toute personne qui accède et navigue sur la PLATEFORME après s’être créée un COMPTE et qui n’a pas encore publié d’images.
ARTICLE 3. ACCEPTATION DES CONDITIONS GENERALES
L’utilisation des fonctionnalités de la PLATEFORME et des SERVICES implique l’acceptation des présentes CGU.
Ainsi, l’UTILISATEUR s’engage à lire attentivement les présentes CGU lors de l’accès à la PLATEFORME et est invité à les télécharger, les imprimer et à en conserver une copie.
Il est précisé que les présentes CGU sont référencées en bas de chaque page du site Internet de la PLATEFORME au moyen d’un lien hypertexte et peuvent ainsi être consultées à tout moment.
Sur l’Application, ces CGU sont accessibles depuis les préférences de l’UTILISATEUR, accessibles via son menu.
ARTICLE 4. SPECIFICATIONS TECHNIQUES
En utilisant la PLATEFORME, l’UTILISATEUR reconnaît disposer des moyens et compétences nécessaires à l’utilisation de la PLATEFORME.
Les équipements nécessaires à l’accès et à l’utilisation de la PLATEFORME sont à la charge de l’UTILISATEUR, de même que les frais de télécommunications induits par leur utilisation.
ARTICLE 5. ROLE DE L’OPERATEUR
5.1. Intervention en tant que simple intermédiaire
La PLATEFORME éditée par EION consiste notamment à mettre en relation, par voie électronique, les UTILISATEURS en vue du partage de leur CONTENU.
Il est précisé que les présentes Conditions Générales d’Utilisation ne confèrent en aucun cas aux UTILISATEURS la qualité de salarié, mandataire, agent ou représentant de EION.
5.2. Loyauté, Clarté et Transparence
En tant qu’opérateur de plateforme en ligne, EION agit de manière neutre, claire et transparente.
EION n’entretient aucun lien capitalistique ou de quelconque dépendance juridique avec un des UTILISATEURS référencés sur la PLATEFORME qui influencerait le classement ou le référencement des CONTENUS.
Les CONTENUS présentés aux internautes sur la PLATEFORME sont référencés de la manière suivante :
- Lorsque l’UTILISATEUR ouvre l’application, le STREAM d’EION est affiché. Dans ce STREAM sont référencées de manière antéchronologiques les images de l’UTILISATEUR, les images des UTILISATEURS dont l’UTILISATEUR est fan est chez qui il est abonné, les images sélectionnées par EION dans la playlist "Discover and explore eion" et les images des playlists auxquelles l'utilisateur est abonné.
- Sur le PROFIL de chaque UTILISATEUR, les CONTENUS publiés par ledit UTILISATEURS sont affichés de manière antéchronologique ;
- L’UTILISATEUR peut également accéder aux différents contenus des UTILISATEURS en effectuant une recherche par UTILISATEUR ou par GROUPE, via le moteur de recherche mis à leur disposition par EION.
- L’UTILISATEUR peut également effectuer une recherche d’image par mots clefs sur les images des UTILISATEURS PRO, via le moteur de recherche mis à leur disposition par EION.
- Par ailleurs, au sein du moteur de recherche, EION présente à l’UTILISATEUR des suggestions de PROFILS. Les PROFILS suggérés à l’UTILISATEUR sont sélectionnés par les ADMINISTRATEURS selon leur travail, leur diversité et leur niveau d’implication au sein d’EION.
- L’UTILISATEUR peut également, via son historique, accéder aux derniers PROFILS visités, classés de manière antéchronologique.
Mis à part concernant le cas des suggestions d’EION présentées dans le moteur de recherche, L’UTILISATEUR est informé du fait que EION ne favorise aucun UTILISATEUR en présentant en priorité ses CONTENUS.
Si le nombre de visiteur unique mensuel sur la PLATEFORME est supérieur à cinq millions de visiteurs uniques par mois, EION diffusera des bonnes pratiques.
5.3 Modération
EION procédera à la modération des CONTENUS publiés sur la PLATEFORME sur le fondement de l’ensemble des obligations décrites au sein des présentes CGU et notamment des obligations listées à l’article 8.1 des présentes.
Dans le cas où le CONTENU publié par un UTILISATEUR contreviendrait à l’un des critères évoqués ci-avant, EION se réserve le droit de : .
- Supprimer les CONTENUS concernés;
- Suspendre le COMPTE de l’UTILISATEUR;
- Rendre le CONTENU et / ou l’UTILISATEUR invisible en cas de contestation ou litige envers son CONTENU, le temps de permettre à l’UTILISATEUR de répondre et de corriger éventuellement le CONTENU. L’UTILISATEUR rendu invisible ne peut plus être vu sur la PLATEFORME et ne peut plus avoir d’interactions avec d’autres UTILISATEURS de la PLATEFORME. Il n’a accès qu’à son propre CONTENU.
Dans l’hypothèse où un UTILISATEUR fait l’objet d’une suspension de COMPTE ou s’il est rendu invisible, ce dernier sera automatiquement déconnecté de la PLATEFORME.
Lors de sa reconnexion, deux situations peuvent se présenter :
- Si l’UTILISATEUR a été rendu invisible : il sera informé par email des manquements qui lui sont reprochés et sera invité à les résoudre;
- Si le COMPTE de l’UTILISATEUR a été suspendu : il sera informé par email et sera invité à résilier son achat via les préférences de son téléphone en appuyant sur le bouton « Gérer les abonnements ».
ARTICLE 6. CONDITIONS D’ACCES ET D’INSCRIPTION
L’UTILISATEUR doit se créer un COMPTE pour pouvoir utiliser la PLATEFORME et bénéficier des SERVICES décrits à l’article 7 des présentes CGU.
Tout UTILISATEUR souhaitant avoir un accès total à l’ensemble des fonctionnalités gratuites proposées par la PLATEFORME devra préalablement se créer un COMPTE.
L’inscription sur la PLATEFORME en tant qu’UTILISATEUR est gratuite.
Pour créer un COMPTE, l’UTILISATEUR est invité à fournir des informations suivantes :
- Nom ;
- Prénom ;
- Type de COMPTE (individuel ou marque, société, célébrité) ;
- Pseudo (l’UTILISATEUR peut choisir que son pseudo devienne son nom d’utilisateur plutôt que ses nom et prénom) ;
- Activité ;
- Adresse email ;
- Mot de passe ;
- Sexe ;
- Age ;
- Url EION ;
L’âge minimum pour s’inscrire sur la PLATEFORME est de 13 ans. Concernant les mineurs de moins de 15 ans, ces derniers doivent bénéficier du consentement de leur représentant légal pour s’inscrire sur la PLATEFORME.
L’UTILISATEUR souhaitant se créer un COMPTE s’engage à fournir à EION des données exactes, loyales et à jour, qui ne portent pas atteinte, à quelque titre que ce soit, aux droits des tiers et à communiquer à EION toute mise à jour nécessaire des données communiquées lors de son inscription.
Enfin, l’UTILISATEUR devra valider les présentes CGU avant de finaliser son inscription.
A compter de la complétion du formulaire d’inscription, l’UTILISATEUR recevra par email, un code lui permettant de valider son inscription.
L’UTILISATEUR aura alors le statut de SPECTATEUR qui lui permettra d’accéder à l’ensemble de la plateforme sans restrictions.
Un UTILISATEUR qui visite le profil d'un SPECTATEUR, qui n'a pas encore publié d'images, voit le stream des images likées par ce SPECTATEUR.
Un UTILISATEUR peut devenir FAN chez un SPECTATEUR auquel cas il recevra une notification lorsque ce SPECTATEUR commencera à publier des images et que ces images auront été vérifiées par EION.
Dès qu’un SPECTATEUR commence à publier une (1) image, il doit publier au total trois (3) images afin qu’EION puisse vérifier que ces images sont bien conformes aux contenus autorisés / non autorisés sur la plateforme et tels que décrits à l’article 8.1 ci-après et conformes au regard des présentes CGU.
Lors de cette vérification, l’UTILISATEUR passe au statut « En attente ». Ses images publiées ne sont pas encore visibles par d’autres UTILISATEURS.
Une fois les trois (3) images publiées par l'UTILISATEUR et vérifiées par EION, l’UTILISATEUR passe du statut de SPECTATEUR à celui de FREE, et peut publier librement sur EION. Ses images deviennent alors visibles par tous les UTILISATEURS.
L’UTILISATEUR reçoit un email de confirmation lui indiquant lorsque ses images ont été vérifiées.
L’UTILISATEUR peut créer plusieurs COMPTES. En tout état de cause, pour pouvoir accéder à un autre COMPTE, il devra se déconnecter du COMPTE auquel il est connecté sur la PLATEFORME.
L’UTILISATEUR est entièrement responsable de l’exactitude et de la mise à jour des données communiquées dans le cadre de l’ouverture et de la gestion de son COMPTE.
6.1. Souscription à l’Abonnement PRO
L’UTILISATEUR inscrit sur la PLATEFORME peut souscrire à un abonnement PRO mensuel.
L’UTILISATEUR devra se rendre sur l’onglet « Devenir PRO » de la PLATEFORME. Il sera alors renvoyé vers l’App Store de son téléphone.
La montant de l’abonnement PRO est indiqué sur la PLATEFORME et est prélevé par l’opérateur opérant l’App Store du téléphone de l’UTILISATEUR. Ce dernier est tenu de se rendre dans les préférences de son téléphone, dans l’onglet « Gérer les abonnements » en cas de résiliation de l’abonnement conformément à la procédure décrite à l’article 6.3 des présentes.
6.2. Gestion des IDENTIFIANTS
L’UTILISATEUR sera seul responsable de l'utilisation de ses IDENTIFIANTS ou des actions faites par l'intermédiaire de son COMPTE.
Dans le cas où un UTILISATEUR divulguerait ou utiliserait ses IDENTIFIANTS de façon contraire à leur destination, EION pourra alors résilier le COMPTE sans préavis ni indemnité.
En aucun cas, EION ne saurait être tenu responsable en cas d’usurpation de l’identité d’un UTILISATEUR. Tout accès et action effectués à partir du COMPTE d’un UTILISATEUR seront présumés être effectués par cet UTILISATEUR, dans la mesure où EION n’a pas pour obligation et ne dispose pas des moyens techniques lui permettant de s’assurer de l’identité des personnes ayant accès à la PLATEFORME à partir d’un COMPTE.
Toute perte, détournement, ou utilisation non autorisée des IDENTIFIANTS d’un UTILISATEUR et leurs conséquences relèvent de la seule responsabilité de l’UTILISATEUR, ce dernier étant tenu d’en avertir EION, sans délai, par message électronique adressé à l’adresse suivante : base@eion.io
6.2. Désinscription
L’UTILISATEUR peut à tout moment fermer son COMPTE en envoyant un mail à l’adresse : base@eion.io. EION procèdera dans les meilleurs délais à une désactivation du COMPTE et adressera à l’UTILISATEUR un courriel lui confirmant la clôture de son COMPTE et de la suppression définitive de l’ensemble de ses CONTENUS sur la PLATEFORME.
Concernant les UTILISATEURS ayant souscrit à l’abonnement PRO, ce dernier est tenu d’annuler le paiement récurent de l’abonnement dans le menu des préférences de son téléphone. EION adressera un courriel à l’UTILISATEUR ayant formulé une demande de désinscription, l’invitant à résilier son achat et lui fournissant un lien vers les préférences de son téléphone.
ARTICLE 7. SERVICES
EION propose des services gratuits et des services payants.
Article 7.1. Services proposés gratuitement à tous les UTILISATEURS
Tout UTILISATEUR s’étant créé un COMPTE peut accéder gratuitement à la PLATEFORME, ainsi qu’à ses différentes fonctionnalités.
Article 7.1.1 Publication de CONTENU
L’UTILISATEUR peut publier du CONTENU sur la PLATEFORME.
L’UTILISATEUR est limité à une (1) publication toutes les vingt-quatre (24) heures (sans abonnement PRO).
Par ailleurs, l’UTILISATEUR a accès aux cent (100) dernières images qu'il a publié (sans abonnement PRO).
Un CONTENU sous forme d’image est toujours publié avec un titre. Par défaut, le titre est la date de prise de vue de l’image.
L’UTILISATEUR peut définir pour son image :
- Un titre ;
- Une description ;
- Un cadre de présentation ;
- Une géolocalisation ;
- Une couleur de masque.
L'UTILISATEUR choisit de publier son CONTENU :
- Dans son STREAM ;
- Dans une COLLECTION ;
- Dans une COLLECTION privée ;
- Dans un GROUPE ;
- Dans un EVENT.
L’image peut être publiée de façon permanente ou éphémère selon un délai choisi par l’UTILISATEUR.
Avant toute publication d’une image, l’UTILISATEUR est invité à garantir qu’il est bien l’auteur de l’image et / ou qu’il détient bien les droits de diffusion lui permettant de publier ladite image.
Par ailleurs, l’UTILISATEUR devra indiquer si son image ou les textes associés contiennent :
- De la nudité ;
- De la violence ou violence légère ;
- Des insinuations à caractère sexuels ;
- De la drogue ;
- De l’alcool.
Les CONTENUS publiés par l’UTILISATEUR seront classés par l’UTILISATEUR selon les catégories suivantes :
- Catégorie 13 + (UTILISATEURS entre 13 et 15 ans) : images ou texte contenant de la violence légère, des insinuations à caractère sexuels, de la drogue et de l’alcool.
- Catégorie 16 + (UTILISATEURS entre 16 et 17 ans) : images ou texte contenant de la nudité ou de la violence.
Si certains CONTENUS publiés par l’UTILISATEUR entrent dans l’une de ces catégories d’âge ou publiées pour tous, EION se réserve le droit de flouter l’image en l’accompagnant d’un message de mise en garde. L’UTILISATEUR devra alors donner son accord pour pouvoir visualiser lesdits CONTENUS.
Le cas où un utilisateur, par négligence ou délibérément, publie une image non appropriée (images ou texte contenant de la violence légère, des insinuations à caractère sexuels, de la drogue et de l’alcool / images ou texte contenant de la nudité ou de la violence) sans avoir pris le soin, lors de la publication de cette image, de vérifier et définir la catégorie d’âge (13+ ou 16+), est un motif de suspension immédiate du compte de cet utilisateur sur eion.
Plusieurs formats de publication sont disponibles :
- Image simple avec un titre et une description optionnelle :
L’UTILISATEUR peut publier une image simple et ajouter un titre et une description optionnelle. L’UTILISATEUR peut éditer l’image publiée.
Avant la publication du CONTENU, l’UTILISATEUR peut sélectionner une durée de publication et faire en sorte que l’image disparaisse après un certain délai.
- Collage :
La publication sous forme de collage est constituée par la superposition d’un premier plan avec un arrière-plan. Le titre de l’image ainsi créée est « Collage » et ne peut être modifié.
Avant la publication du CONTENU, l’UTILISATEUR peut sélectionner une durée de publication et faire en sorte que le COLLAGE disparaisse après un certain délai.
- Collab :
L’UTILISATEUR ajoute une moitié d’image et invite un autre UTILISATEUR à compléter l’autre moitié. Le titre de l’image ainsi créée est « Collab » et ne peut être modifié.
Article 7.1.2. Recherche par le moteur de recherche
L’UTILISATEUR peut, lorsqu’il recherche un GROUPE, un UTILISATEUR, ou un MOT CLEF (ex : une recherche sur le mot clef : « Paris ») utiliser le moteur de recherche.
Dans un tel cas de figure, les résultats correspondant à sa recherche lui seront classés en plusieurs catégories :
- EION : présente, par ordre alphabétique, les PROFILS correspondants à la recherche de l’UTILISATEUR ;
- EION : présente, dans le cas d’une recherche par mot clef, les images les plus récentes des UTILISATEURS PRO dont le titre contient le MOT CLEF, dans l’onglet PRO et correspondant à la recherche de l’UTILISATEUR ;
- GROUPS / EVENTS : les GROUPS ou EVENTS correspondants à la recherche de l’UTILISATEUR sont présentés par ordre alphabétique.
Article 7.1.3. Interaction entre UTILISATEURS
7.1.3.1 Devenir Fan
Chaque UTILISATEUR peut devenir fan d’un autre UTILISATEUR en se rendant sur la page d’accueil de son PROFIL et en cliquant sur « Devenir fan », ou via le menu.
Le STREAM EION présente de manière antéchronologique le CONTENU des UTILISATEURS dont l’UTILISATEUR est fan.
L’UTILISATEUR peut cesser d’être fan d’un autre UTILISATEUR à tout moment.
7.1.3.2 Envoyer et recevoir des Messages
L’UTILISATEUR peut envoyer un message à un autre UTILISATEUR par email, sous réserve d’obtenir son accord préalable.
7.1.3.3 Invitation
L’UTILISATEUR peut inviter un autre UTILISATEUR :
- Voir une image ;
- Voir un PROFIL ;
- Voir une COLLECTION.
- Rejoindre un GROUPE ou un EVENT.
L’invitation peut concerner le CONTENU de l’UTILISATEUR expéditeur de l’invitation, ou le CONTENU d’un autre UTILISATEUR.
7.1.3.4. Likes
Chaque UTILISATEUR peut liker le CONTENU d’autres UTILISATEUR en cliquant sur l’icône représentée par un cœur. Le STREAM de like permet à l’UTILISATEUR d’une part de voir l’ensemble des CONTENUS qu’il a liké, et d’autre part, l’ensemble des CONTENUS likés des UTILISATEURS chez qui l’UTILISATEUR est fan.
L’UTILISATEUR peut pour chaque autre UTILISATEUR voir l’ensemble des CONTENUS que cet autre UTILISATEUR a liké.
Article 7.1.4 Devenir membre d’un GROUPE ou EVENT
Chaque UTILISATEUR peut devenir membre d’un GROUPE ou d’un EVENT. Les STREAM des GROUPES regroupent tous les CONTENUS publiés dans les GROUPES ou EVENTS auquel l’UTILISATEUR a adhéré.
Un GROUPE permet à plusieurs UTILISATEURS y ayant adhéré, de publier du CONTENU autour d’un thème. L’accord de l’UTILISATEUR ayant créé le GROUPE est nécessaire pour pouvoir accéder audit GROUPE.
Un EVENT est un GROUPE organisé autour d’un évènement et ayant une date de début et une date de fin. Les UTILISATEURS ayant rejoint l’EVENT peuvent publier du CONTENU sur cet EVENT jusqu’à sa date de fin.
Article 7.1.5 Création de COLLECTIONS
Chaque UTILISATEUR peut créer des COLLECTIONS pour ranger et organiser ses images selon ses propres critères, auxquelles l’UTILISATEUR peut accéder par son menu.
Les COLLECTIONS peuvent être visibles par tous les UTILISATEURS. L’UTILISATEUR peut également choisir de créer une ou plusieurs COLLECTION(S) privée(s). Dans ce cas, seul l’UTILISATEUR créateur de la COLLECTION privée pourra y accéder.
Une COLLECTION visible peut devenir privée et inversement.
L’UTILISATEUR peut ajouter des invités dans ses COLLECTIONS privées pour qu’ils visualisent ou téléchargent le CONTENU de ladite COLLECTION.
Article 7.1.6 QR Codes
Afin de faciliter le partage d’un CONTENU sur la PLATEFORME, EION dispose d’un lecteur et d’un générateur de QR codes.
En scannant un QR Code, l’UTILISATEUR accède au CONTENU à partir duquel a été créé le QR Code.
Article 7.1.7 Appareil photo
L’UTILISATEUR peut prendre des photos à partir de l’application EION.
Article 7.1.8. Accès aux préférences du COMPTE
En se créant un COMPTE, l’UTILISATEUR peut modifier ses informations personnelles dans ses préférences accessibles depuis son menu et sur sa home.
L’UTILISATEUR peut modifier :
- Son à propos ;
- Son avatar ;
- Son adresse ;
- Son téléphone ;
- Son métier.
Sur sa home, l’UTILISATEUR pourra également avoir un aperçu de ses 5 dernières activités (les likes reçus par lui ou les UTILISATEURS dont il est fan, suivre les invitations envoyées ou reçues).
7.1.9 Accès au menu du COMPTE
Via son menu, l’UTILISATEUR pourra créer et accéder à ses COLLECTIONS et COLLECTIONS privées.
Il pourra également accéder aux GROUPES et EVENTS dont il est membre, et créer de nouveaux GROUPES ou EVENTS.
7.1.10 Accès aux activités
L’UTILISATEUR peut avoir accès à l’ensemble de ses dernières activités (publication de ses fans, intégration de GROUPES ou EVENTS, likes reçus, etc.).
7.1.11 Signalement de CONTENU
L’UTILISATEUR peut avoir accès à l’ensemble de ses dernières activités (publication de ses fans, intégration de GROUPES ou EVENTS, likes reçus, etc.).
EION procédera à la modération dudit CONTENU dans les conditions définies à l’article 5.3 des présentes CGU.
Lorsqu’un UTILISATEUR procède au signalement d’un CONTENU, ledit CONTENU est rendu invisible pour cet UTILISATEUR
Article 7.2. Abonnement PRO
L’UTILISATEUR peut souscrire à un abonnement PRO dans les conditions prévues à l’article 6.1.
Le paiement de l’abonnement PRO donne à l’UTILISATEUR accès aux SERVICES suivants :
Article 7.2.1 Publication illimitée de CONTENU
L’UTILISATEUR peut publier du CONTENU sur la PLATEFORME dans les conditions détaillées à l’article 7.1.1 des présentes, sauf dans ces dispositions relatives à la limite de CONTENU pouvant être publié.
L’UTILISATEUR peut donc publier du CONTENU sur la PLATEFORME de manière illimitée.
Article 7.2.2 Accès à l’intégralité du CONTENU publié
Dans le cadre de l’abonnement PRO, l’UTILISATEUR peut accéder à l’intégralité du CONTENU qu’il aura publié sur la PLATEFORME, indépendamment de la limite de 100 (cent) dernières images accordés aux UTILISATEURS n’ayant pas souscrit à l’abonnement PRO.
Article 7.2.3 Création de e-books
Dans le cadre de l’abonnement PRO, l’UTILISATEUR peut créer des e-books avec plus de 5 images.
ARTICLE 8. OBLIGATION DES PARTIES
8.1. Obligations des UTILISATEURS
Dans le cadre de l’utilisation de la PLATEFORME, chaque UTILISATEUR s’engage à ne pas porter atteinte à l’ordre public et à se conformer aux lois et règlements en vigueur, à respecter les droits des tiers et les dispositions des présentes CGU.
Chaque UTILISATEUR a pour obligation de :
- Se comporter de façon loyale et de façon raisonnable à l’égard de EION et des tiers ;
- Être honnête et sincère dans les informations fournies à EION et, le cas échéant aux tiers UTILISATEURS ;
- Utiliser la PLATEFORME conformément à son objet tel que décrit dans les présentes CGU ;
- Ne pas détourner la finalité de la PLATEFORME pour commettre des crimes, délits ou contraventions réprimés par le Code pénal ou toute autre loi ;
- Respecter la vie privée des tiers et la confidentialité des échanges ;
- Respecter les droits de propriété intellectuelle de EION portant sur les éléments de la PLATEFORME et les droits de propriété intellectuelle des autres UTILISATEURS ;
- Ne pas chercher à porter atteinte au sens des articles 323-1 et suivants du Code pénal aux systèmes de traitements automatisés de données mis en œuvre sur la PLATEFORME ;
- Ne pas modifier les informations mises en ligne par EION ou par un autre UTILISATEUR ;
- Ne pas utiliser la PLATEFORME pour envoyer massivement des messages non sollicités (publicitaires ou autres) ;
- Ne pas diffuser des données ayant pour effet de diminuer, de désorganiser, de ralentir ou d’interrompre le fonctionnement normal de la PLATEFORME.
Dans le respect des dispositions légales et réglementaires en vigueur et conformément à la loi du 29 juillet 1981 relative à la liberté de la presse, l’UTILISATEUR s’engage à ne pas diffuser de message ou information :
- Constitutifs de dénigrement fautif visant EION ou les UTILISATEURS ;
- Contraires à l’ordre public et aux bonnes mœurs ;
- À caractère injurieux, diffamatoire, raciste, xénophobe, révisionniste ou portant atteinte à l'honneur ou à la réputation d'autrui ;
- Incitant à la discrimination, à la haine d'une personne ou d'un groupe de personnes à raison de leur origine ou de leur appartenance ou de leur non-appartenance à une ethnie, une nation, une race ou une religion déterminée ;
- Menaçant une personne ou un groupe de personnes ;
- À caractère pédophile ;
- A caractère pornographique ;
- Incitant à commettre un délit, un crime ou un acte de terrorisme ou faisant l'apologie des crimes de guerre ou des crimes contre l'humanité ;
- Incitant au suicide ;
- Permettant à des tiers de se procurer directement ou indirectement des logiciels piratés, des numéros de série de logiciels, des logiciels permettant des actes de piratage et d'intrusion dans les systèmes informatiques et de télécommunications, des virus et autres bombes logiques et d'une manière générale tout outil logiciel ou autre permettant de porter atteinte aux droits d'autrui et à la sécurité des personnes et des biens ;
- À caractère commercial (prospection, racolage, prostitution…).
8.2. Obligations de EION
L’obligation générale de EION est une obligation de moyens. Il ne pèse sur EION aucune obligation de résultat ou de moyens renforcée d’aucune sorte.
EION s’engage à mettre tous les moyens en œuvre pour assurer une continuité d’accès et d’utilisation de la PLATEFORME 7 jours sur 7 et 24 heures sur 24.
EION attire toutefois l’attention des UTILISATEURS sur le fait que les protocoles actuels de communication via Internet ne permettent pas d’assurer de manière certaine et continue la transmission des échanges électroniques (messages, documents, identité de l’émetteur ou du destinataire).
Par ailleurs, en tant qu’opérateur de plateforme en ligne, EION s’engage à apporter une information claire transparente et loyale sur les modalités de son intervention, notamment dans l’article 5.2. des présentes.
ARTICLE 9. RESPONSABILITE
9.1. Principes généraux
EION décline toute responsabilité notamment :
- En cas d’impossibilité d’accéder temporairement à la PLATEFORME pour des opérations de maintenance technique ou d’actualisation des informations publiées. Les UTILISATEURS reconnaissent que la responsabilité de EION ne saurait être engagée en cas de dysfonctionnements ou d’interruptions desdits réseaux de transmission ;
- En cas d’attaques virales, intrusion illicite dans un système de traitement automatisé de données ;
- En cas d’utilisation anormale ou d’une exploitation illicite de la PLATEFORME par un UTILISATEUR ou un tiers ;
- Relativement au contenu des sites internet tiers vers lesquels renvoient des liens hypertextes présents sur la PLATEFORME ;
- En cas de non-respect des présentes CGU imputable aux UTILISATEURS ;
- En cas de retard ou d’inexécution de ses obligations, lorsque la cause du retard ou de l’inexécution est liée à un cas de force majeure telle qu’elle est définie à l’article 10 des présentes CGU ;
- En cas de cause étrangère non imputable à EION ;
En cas d’utilisation anormale ou d’une exploitation illicite de la PLATEFORME, l’UTILISATEUR est alors seul responsable des dommages causés aux tiers et des conséquences des réclamations ou actions qui pourraient en découler.
9.2. Litiges entre UTILISATEURS
EION attire l’attention des UTILISATEURS sur le fait que tout litige survenant entre UTILISATEURS devra être traité entre eux.
En cas de litige avec un UTILISATEUR l’autre UTILISATEUR pourra contacter le Service Client de EION en envoyant un courriel à l’adresse base@eion.io ou un courrier à eion, 5 rue Legouvé 75010 Paris.
EION répercutera la réclamation auprès de l’UTILISATEUR concerné qui sera seul responsable du traitement du litige.
EION pourra uniquement, le cas échéant, intervenir en tant que médiateur.
ARTICLE 10. FORCE MAJEURE
La responsabilité de EION ne pourra pas être mise en œuvre si la non-exécution ou le retard dans l’exécution de l’une de ses obligations décrites dans les présentes CGU découle d’un cas de force majeure.
Il y a force majeure en matière contractuelle lorsqu’un évènement échappant au contrôle du débiteur, qui ne pouvait être raisonnablement prévu lors de la conclusion du contrat et dont les effets ne peuvent être évités par des mesures appropriées, empêche l’exécution de son obligation par le débiteur.
Si l’empêchement est temporaire, l’exécution de l’obligation est suspendue à moins que le retard qui en résulterait ne justifie la résolution du contrat. Si l’empêchement est définitif, le contrat est résolu de plein droit et les parties sont libérées de leurs obligations dans les conditions prévues aux articles 1351 et 1351-1 du Code civil.
A ce titre, la responsabilité de EION ne pourra pas être engagée notamment en cas d'attaque de pirates informatiques, d'indisponibilité de matériels, fournitures, pièces détachées, équipements personnels ou autres ; et d'interruption, de suspension, de réduction ou des dérangements de l'électricité ou autres ou toutes interruptions de réseaux de communications électroniques, ainsi qu’en cas de survenance de toute circonstance ou événement extérieur à la volonté de EION intervenant postérieurement à la conclusion des CGU et en empêchant l’exécution dans des conditions normales.
Il est précisé que, dans une telle situation, l’UTILISATEUR ne peut réclamer le versement d’aucune indemnité et ne peut intenter aucun recours à l’encontre de EION.
En cas de survenance d’un des évènements susvisés, EION s’efforcera d’informer l’UTILISATEUR dès que possible.
ARTICLE 11. PROPRIETE INTELLECTUELLE
11.1 Titularité des droits de propriété intellectuelle des UTILISATEURS
Dans le cadre de la publication de CONTENUS via la PLATEFORME, les UTILISATEURS présentent des images leur appartenant ou appartenant à des tiers et dont ils détiennent les droits de difusion.
Tout UTILISATEUR téléversant du CONTENU sur la PLATEFORME garantit qu’il a le droit de faire une représentation de tous les éléments incorporels présentés dans les CONTENUS.
Par ailleurs, l’UTILISATEUR concède à EION pendant toute la durée de la relation entre les PARTIES, une licence portant sur son droit de reproduction,
SUR LA PLATEFORME UNIQUEMENT, afin de lui permettre de diffuser ses CONTENUS sur la PLATEFORME.
Dans le cadre de l’utilisation des SERVICES, l’UTILISATEUR a la possibilité de créer des COLLAGE, ou des COMPOS. Il peut également créer des COLLABS avec un autre UTILISATEUR.
Dans le cadre des COLLAGE et des COMPOS, l’UTILISATEUR en étant à l’origine demeure titulaire des droits de propriété intellectuelle sur son œuvre créée en utilisant les services d’EION.
Dans le cadre des COLLAB, les deux UTILISATEURS ayant collaborés pour la réalisation d’une œuvre en sont tous les deux propriétaires.
De la même manière, l’UTILISATEUR est propriétaire des droits d’auteur relatifs aux images prises grâce à l’appareil photo d’EION. Lorsqu’un UTILISATEUR prend une photo avec l’appareil photo mis à disposition par EION, une mention « copyright » est précisée au sein des méta-données de l’image. Cette mention précise le nom d’UTILISATEUR.
Si l’image possède un copyright au sein de ses méta-données, l’UTILISATEUR sera informé de ce copyright au moment où il publie l’image.
Ce copyright sera affiché quand l’utilisateur effectuera un tap sur le bouton représentant le symbole du copyright.
Ce copyright sera également affiché sous forme de texte au-dessus de l’image en bas à droite.
Si le copyright est absent quand l’UTILISATEUR publie une image, car non renseigné au sein des méta-données de l’image, le nom de l’UTILISATEUR sera affiché en bas à droite de l’image (sans le symbole de copyright ©).
EION interdit expressément tout UTILISATEUR d’effectuer une capture écran de tout CONTENU publié par un autre UTILISATEUR afin de réutiliser ledit CONTENU.
11.2 Titularité des droits de propriété intellectuelle de EION
L’UTILISATEUR reconnaît les droits de propriété intellectuelle de EION sur la PLATEFORME, ses composantes et les contenus y afférent et renonce à contester ces droits sous quelle que forme que ce soit.
Les marques, logos, slogans, graphismes, photographies, animations, vidéos, solutions logicielles et textes et tout autre contenu sur la PLATEFORME,
À L'EXCEPTION DES CONTENUS PUBLIÉS PAR LES UTILISATEURS, sont la propriété intellectuelle exclusive de EION et ne peuvent être reproduits, utilisés ou représentés sans autorisation expresse sous peine de poursuites judiciaires.
Toute représentation ou reproduction, totale ou partielle, de la PLATEFORME et de son contenu, par quel que procédé que ce soit, sans l’autorisation préalable expresse de EION, est interdite et constituera une contrefaçon sanctionnée par les articles L.335-2 et suivants et les articles L.713-1 et suivants du Code de la Propriété Intellectuelle.
En particulier, EION interdit expressément :
- L’extraction, par transfert permanent ou temporaire de la totalité ou d’une partie qualitativement ou quantitativement substantielle du contenu de sa base de données sur un autre support, par tout moyen et sous quelque forme que ce soit ;
- La réutilisation, par la mise à la disposition du public de la totalité ou d’une partie qualitativement ou quantitativement substantielle du contenu de la base, quelle qu’en soit la forme ;
- La reproduction, l’extraction ou la réutilisation, par tout moyen, des contenus (photographies, description etc…) publiés par EION ou par un UTILISATEUR.
L’acceptation des présentes CGU vaut reconnaissance par les UTILISATEURS des droits de propriété intellectuelle de EION et engagement à les respecter.
EION accorde une licence personnelle, non-exclusive et non cessible aux UTILISATEURS les autorisant à utiliser la PLATEFORME et les informations qu’elle contient conformément aux présentes CGU.
Toute autre exploitation de la PLATEFORME et de son contenu est exclue du domaine de la présente licence et ne pourra être effectuée sans l’autorisation préalable expresse de EION.
ARTICLE 12. PROTECTION DES DONNEES A CARACTERE PERSONNEL
Dans le cadre de l’exploitation de la PLATEFORME, EION est susceptible de collecter des données à caractère personnel.
Ces données sont nécessaires à la gestion de la PLATEFORME et à la fourniture des SERVICES. Les données sont conservées confidentiellement par EION pour les besoins du contrat, de son exécution et dans le respect de la loi.
A ce titre, l’UTILISATEUR est invité à consulter la Politique de confidentialité, plus bas dans ce document, qui lui donnera l’ensemble des informations relatives à la protection des données à caractère personnel, et aux traitements effectués via la PLATEFORME
Conformément à la loi n°78-17 du 6 janvier 1978 relative à l’informatique aux fichiers et aux libertés et au Règlement (UE) 2016/679 du Parlement européen et du Conseil du 27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des données à caractère personnel et à la libre circulation de ces données, et abrogeant la directive 95/46/CE (Règlement général sur la protection des données dit RGPD), EION assure la mise en œuvre des droits des personnes concernées.
Il est rappelé que l’UTILISATEUR dont les données à caractère personnel sont traitées bénéficie des droits d’accès, de rectification, de mise à jour, de portabilité et d’effacement des informations qui le concernent, conformément aux dispositions des articles 49, 50 et 51 de la loi Informatique et Libertés modifiée, et aux dispositions des articles 15, 16 et 17 du Règlement Général européen sur la Protection des Personnes (RGPD).
Conformément aux dispositions de l’article 38 de la loi Informatique & Libertés modifiée et aux dispositions de l’article 56 du RGPD, l’UTILISATEUR peut également, pour des motifs légitimes, s’opposer au traitement des données le concernant, sans motif et sans frais.
L’UTILISATEUR peut exercer ces droits en adressant un courrier électronique à l’adresse : base@eion.io ou un courrier à EION 5 rue Legouvé 75010 Paris.
ARTICLE 13. SERVICE CLIENTS
Toute question ou réclamation concernant l’utilisation ou le fonctionnement de la PLATEFORME peut être formulée selon les modalités suivantes :

- Par courrier à EION, 5 rue Legouvé, 75010 Paris
Si l’une quelconque des stipulations des présentes CGU venait à être déclarée nulle au regard d’une disposition législative ou réglementaire en vigueur et/ou d’une décision de justice ayant autorité de la chose jugée, elle sera réputée non écrite mais n’affectera en rien la validité des autres clauses qui demeureront pleinement applicables.
Une telle modification ou décision n’autorise en aucun cas les UTILISATEURS à méconnaitre les présentes CGU.
ARTICLE 14. VALIDITE DES CGU
Si l’une quelconque des stipulations des présentes CGU venait à être déclarée nulle au regard d’une disposition législative ou réglementaire en vigueur et/ou d’une décision de justice ayant autorité de la chose jugée, elle sera réputée non écrite mais n’affectera en rien la validité des autres clauses qui demeureront pleinement applicables.
Une telle modification ou décision n’autorise en aucun cas les UTILISATEURS à méconnaitre les présentes CGU.
ARTICLE 15. MODIFICATION DES CGU
Les présentes CGU s’appliquent à tout UTILISATEUR navigant sur la PLATEFORME.
Les CGU pourront être modifiées et mises à jour par EION à tout moment, notamment pour s’adapter à l’évolution législative ou réglementaire.
Les CGU applicables sont celles en vigueur au moment de la navigation sur la PLATEFORME.
Les UTILISATEURS seront notifiés de toute modification envisagée des présentes CGU.
ARTICLE 16. DISPOSITIONS GENERALES
Le fait que l'une des PARTIES n'ait pas exigé l'application d'une clause quelconque des présentes CGU, que ce soit de façon permanente ou temporaire, ne pourra en aucun cas être considéré comme une renonciation à ladite clause.
En cas de difficulté d’interprétation entre l’un quelconque des titres figurant en tête des clauses, et l’une quelconque de celles-ci, les titres seront déclarés inexistants.
ARTICLE 17. COMPETENCE ET DROIT APPLICABLE
LES PRESENTES CGU AINSI QUE LES RELATIONS ENTRE L’UTILISATEUR ET EION SONT REGIES PAR LE DROIT FRANÇAIS.
En cas de différend survenant entre EION et un UTILISATEUR au sujet de l’interprétation, de l’exécution ou de la résiliation des présentes, les PARTIES s’efforceront de le régler à l’amiable.
Dans un tel cas de figure, l’UTILISATEUR est tout d’abord invité à contacter le service de médiation de EION à l’adresse suivante : eion, 5 rue Legouvé 75010 Paris.
Si aucun accord n’est trouvé, il sera alors proposé une procédure de médiation facultative, menée dans un esprit de loyauté et de bonne foi en vue de parvenir à un accord amiable lors de la survenance de tout conflit relatif au présent contrat, y compris portant sur sa validité.
La PARTIE souhaitant mettre en œuvre le processus de médiation devra préalablement en informer l’autre PARTIE par lettre recommandée avec accusé de réception en indiquant les éléments du conflit.
La médiation ne présentant pas un caractère obligatoire, l’UTILISATEUR ou EION peut à tout moment se retirer du processus.
Dans l’hypothèse où la médiation échouerait ou ne serait pas envisagée, le litige ayant pu donner lieu à une médiation sera confié au tribunal compétent.
POLITIQUE DE CONFIDENTIALITE
PREAMBULE
Cette Politique de confidentialité s’adresse à vous, en votre qualité d’UTILISATEUR de la PLATEFORME internet https://www.eion.io et de l’application mobile EION (ci-après la « PLATEFORME ») et a pour objectif de vous informer de la manière dont vos informations personnelles peuvent le cas échéant être collectées et traitées par EION et les PARTENAIRES de la PLATEFORME.
EION, Société par actions simplifiée, au capital de 6.600 euros, immatriculée au RCS de Paris sous le n° 803 693 118, dont le siège social est situé 5, rue Legouvé, 75010 Paris, prise en la personne de son représentant légal, édite et exploite la plateforme internet accessible à l’adresse https://www.eion.io (ci-après « EION » ou « l’OPERATEUR »).
La protection des personnes et des données étant une priorité pour EION, la présente Politique de confidentialité a pour objet de présenter aux UTILISATEURS la teneur des traitements de données à caractère personnel mis en œuvre sur la PLATEFORME.
EION s’engage en tout état de cause à respecter les deux (2) principes essentiels suivants :
- Vous restez maître de vos données à caractère personnel ;
- Vos données sont traitées de manière transparente, confidentielle et sécurisée.

COMPTE : désigne l’interface hébergée sur la PLATEFORME dans laquelle est regroupée l’ensemble des données fournies par les MEMBRES. L’accès au COMPTE se fait grâce aux IDENTIFIANTS.
CONTENU : désigne l’ensemble des photographies, et textes publiés par les UTILISATEURS sur la PLATEFORME.
CO-RESPONSABLE DE TRAITEMENT : désigne les cas où plusieurs entités sont responsables du traitement des données personnelles collectées sur la PLATEFORME et déterminent, ensemble, les moyens et finalités du traitement.
IDENTIFIANTS : désigne l’adresse email, le pseudonyme et le mot de passe renseignés par le MEMBRE lors de la création de son COMPTE, nécessaires à l’accès à son COMPTE sur la PLATEFORME.
OPERATEUR : désigne EION, en tant qu’opérateur de plateforme en ligne.
PLATEFORME : désigne la PLATEFORME internet accessible à l’adresse https://www.eion.io et l’application mobile ; la PLATEFORME regroupe l’ensemble des pages web, services et fonctionnalités proposés aux UTILISATEURS.
RESPONSABLE DE TRAITEMENT : désigne l’entité qui, seule ou conjointement avec une autre, détermine les moyens et finalité d’un traitement de données à caractère personnel.
SERVICES : désigne l’ensemble des services proposés par EION aux UTILISATEURS par l’intermédiaire de la PLATEFORME, et notamment la mise en relation des UTILISATEURS pour la réalisation de CONTENU.
SOUS-TRAITANT : désigne la personne traitant des données à caractère personnel pour le compte du RESPONSABLE DU TRAITEMENT, qui agit sous l’autorité du RESPONSABLE DU TRAITEMENT et sur instruction de celui-ci, cela conformément à l’article 28 du RGPD.
UTILISATEUR : désigne toute personne qui accède et navigue sur la PLATEFORME après s’être créée un COMPTE.
2 - IDENTITE & COORDONNES DU RESPONSABLE DE TRAITEMENT
Le responsable du traitement de vos données est EION, Société par actions simplifiée immatriculée au RCS de Paris sous le numéro 803 693 119 dont le siège social est situé 5, rue Legouvé, 75010.
3 - SUIVI DU TRAITEMENT
Le traitement de vos données à caractère personnel fait l’objet de fiches de traitements qui sont insérées dans le registre des traitements de l’OPERATEUR.
4 - FINALITES DU TRAITEMENT ET BASES LEGALES
Vos différentes données sont susceptibles d’être collectées par l’OPERATEUR afin d’assurer :
L’accès à la PLATEFORME et la fourniture des SERVICES aux UTILISATEURS (T1) ;
Base légale :
- Acceptation des CGU.
- Le consentement de l’UTILISATEUR est requis.
- Il est ainsi obtenu lors de la création de son COMPTE.
L’envoi de notifications par courriel aux UTILISATEURS qui en ont fait la demande (T2) ;
Base légale :
- Le consentement de l’UTILISATEUR est requis.
Gérer et répondre à vos demandes d’exercice de droits « Informatique et Libertés » (T3) ;
Base légale :
- Obligation légale (RGPD et Loi Informatique & Libertés).
Assurer le bon fonctionnement et l’amélioration permanente de notre PLATEFORME et de ses fonctionnalités (T4) ;
Base légale :
- Intérêt légitime de l’OPERATEUR à garantir le meilleur niveau de fonctionnement et de qualité de la PLATEFORME grâce notamment aux statistiques de visites.
En tout état de cause, et pour chaque finalité définie, l’OPERATEUR mettra tous les moyens en sa possession pour assurer la sécurité et la confidentialité des données à caractère personnel qui lui sont confiées, dans le respect des lois et règlement en vigueur.
5 - DONNEES TRAITEES
Les données traitées selon les traitements mis en œuvre sont les suivantes * :
T1 - Accès à la PLATEFORME, intermédiation et fourniture des SERVICES :
- Données à caractère personnel relatives aux UTILISATEURS de la PLATEFORME ;
- Données relatives à la navigation de l’UTILISATEUR sur la PLATEFORME.
T2 - L’envoi de notifications par courriel aux UTILISATEURS qui en ont fait la demande :
- Données à caractère personnel relatives aux UTILISATEURS de la PLATEFORMES.
T3 - Gestion des demandes d’exercice de droit :
- Nom, prénom, numéro de téléphone, adresse email ;
- Le cas échéant, copie de la pièce d’identité.
T4 - Gestion du bon fonctionnement de la PLATEFORME
- Un cookie intitulé "color" permet de conserver la couleur sur chaque site de l’UTILISATEUR ;
- Un cookie intitulé "hblid" permet de conserver la position d'éléments de mise en page sur le site https://www.eion.io ;
- Un cookie intitulé "olfsk" permet de conserver la position d'éléments de mise en page sur le site https://www.eion.io ;
- Un cookie intitulé "_gid" permet de faire état de la visite d'un utlisateur le site https://www.eion.io ;
- Un cookie intitulé "_ga" permet de faire état de la visite d'un utlisateur le site https://www.eion.io ;

- Données relatives à l’identité de la personne concernée : civilité, nom, prénoms, sexe, adresse, numéro de téléphone, adresses email.
- Données relatives aux moyens de paiement : relevé d'identité postale ou bancaire, numéro de chèque, numéro de carte bancaire, date de fin de validité de la carte bancaire, cryptogramme visuel.
6 - DESTINATAIRES DES DONNEES
Seules les personnes mentionnées ci-dessous pourront avoir accès aux données des UTILISATEURS :
- Le personnel habilité des différents services de EION (services administratifs, comptabilité, marketing, commercial, logistique et informatique) ;
- Les sociétés chargées de la gestion de la PLATEFORME ;
- Le cas échéant, le personnel habilité de nos sous-traitants ;
- Le cas échéant, les juridictions concernées, médiateurs, experts-comptables, commissaires aux comptes, avocats, huissiers, sociétés de recouvrement de créances, autorités de police ou de gendarmerie en cas de vol ou de réquisition judiciaire, secours ;
Vos données ne sont communiquées, échangées, vendues ou louées à aucune autre personne que celles mentionnées ci-dessus.
7 - DUREE DE CONSERVATION DES DONNEES
Nous conservons vos données uniquement le temps nécessaire pour les finalités poursuivies, telles que décrites à l’article 4.
T1 - Accès à la PLATEFORME, intermédiation et fourniture des SERVICES : Les données personnelles sont conservées pendant toute la durée de la relation contractuelle avec l’OPERATEUR et stockées ensuite pendant cinq (5) ans dans un objectif de preuve.
T2 - L’envoi de notifications par courriel aux UTILISATEURS qui en ont fait la demande : Les données personnelles sont conservées pendant toute la durée de la relation contractuelle avec l’OPERATEUR et stockées ensuite pendant cinq (5) ans dans un objectif de preuve.
T3 - Gestion des demandes d’exercice de droit : Les données sont conservées un (1) an en cas d’exercice du droit d’accès ou de rectification et trois (3) ans en cas d’exercice du droit d’opposition.
T4 - Gestion du bon fonctionnement de la PLATEFORME : Les données sont conservées pendant une durée de treize (13) mois. Au-delà de ce délai, les données de fréquentation brutes associées à un identifiant sont soit supprimées soit anonymisées.
Par exception, les données d’identification de l’UTILISATEUR sont conservées par l’OPERATEUR pendant une durée de trois (3) ans à compter de la clôture du COMPTE, ou du dernier contact avec le l’UTILISATEUR.
8 - VOS DROITS
Conformément à la Loi Informatique et Libertés et au RGPD, vous disposez des droits suivants :
- Droit d’accès (article 15 RGPD), de rectification (article 16 RGPD), de mise à jour, de complétude de vos données.

EION et ses éventuels sous-traitants s’engagent à mettre en œuvre toutes les mesures techniques et organisationnelles afin d’assurer la sécurité de nos traitements de données à caractère personnelle et la confidentialité de vos données, en application de la Loi informatique et Libertés et du Règlement européen sur la protection des données (RGPD) et de la loi n°2018-133 du 26 février 2018 « portant diverses dispositions d’adaptation au droit de l’Union européenne dans le domaine de la sécurité ».
A ce titre, EION prend les précautions utiles, au regard de la nature de vos données et des risques présentés par notre traitement, pour préserver la sécurité des données et, notamment, empêcher qu’elles soient déformées, endommagées, ou que des tiers non autorisés y aient accès (protection physique des locaux, procédé d’authentification de nos clients avec accès personnel et sécurisé via des identifiants et mots de passe confidentiels, journalisation des connexions, chiffrement de certaines données,…).
12 - TRANSFERTS HORS UE
L’OPERATEUR s’engage à ne pas transférer les données des UTILISATEURS en dehors de l’Union Européenne.
Dans l’hypothèse où l’OPERATEUR devrait le faire, il en informerait les UTILISATEURS en indiquant les mesures prises afin de contrôler ce transfert et s’assurer du respect de la confidentialité de leurs données.

GENERAL CONDITIONS OF USE (T & Cs)
The purpose of these GENERAL CONDITIONS OF USE, concluded with USERS, is to lay down the contractual provisions relating to the rights and obligations of each in the context of the use of our SERVICES.

ANY USE MADE FOR ANY PURPOSE OF THE PLATFORM MANDATORY IMPLIES UNRESERVED ACCEPTANCE BY THE USER OF THESE GENERAL CONDITIONS OF USE (T & Cs).
ARTICLE 1. LEGAL INFORMATION
The EION platform is published by EION S.A.S., a simplified joint-stock company, registered in the Paris, France, Trade and Companies Register under number 803 693 118, whose head office is at 5, rue Legouvé, 75010 Paris (hereinafter " EION ”or“ the OPERATOR ”).
ARTICLE 2. DEFINITIONS
The terms mentioned below have the following meanings in these GENERAL CONDITIONS OF USE:
"COLLAB": refers to the possibility for the USER to invite another USER for the creation of CONTENT.
"COLLAGE": refers to the possibility for a USER to paste two photos to create a single CONTENT.
"COLLECTION": refers to the collection of different content organized by the USER. The COLLECTION can be public or private.
"ACCOUNT": refers to the interface hosted on the PLATFORM in which all the data provided by the USER is grouped. Access to the ACCOUNT is through IDENTIFIERS.
"COMPO": refers to the possibility for a USER to attach two or more photos for the creation of CONTENT.
"GENERAL CONDITIONS OF USE" or "T & Cs": refers to these contractual conditions made available on the home page of the PLATFORM, in order to regulate the use thereof by any USER.
"CONTENT": refers to all the photographs and texts published by USERS on the PLATFORM.
"EVENT": means a group organized around an event and having a start date and an end date.
"GROUPS": refers to a collection of CONTENT publications grouped around a theme.
"IDENTIFIERS": refers to the email address and password entered by the USER when creating his ACCOUNT, necessary for access to his ACCOUNT on the PLATFORM.
"PLATFORM": refers to the internet PLATFORM accessible at the address https://www.eion.io and the mobile application downloadable from the Apple Store. The PLATFORM brings together all the web pages, services and functionalities offered to USERS.
"PLAYLIST": refers to a set of images collected around the same theme and organized, added or deleted by ADMINISTRATORS, to which a USER chooses to subscribe. The "Discover and explore EION" Playlist means a set of images organized, added or deleted by ADMINISTRATORS according to the quality of the images and their diversity, unrelated to a particular theme and to which all USERS are subscribed.
"PROFILE": refers to the public interface of a USER'S ACCOUNT
"SERVICES": refers to all the services offered by EION to USERS through the PLATFORM, and in particular:
- Putting USERS in touch with each other;
- Portfolios;
- A camera;
- A photo library.
"STREAM": refers to the interface gathering all the published CONTENT combining images and texts. The STREAM can be attached to a PROFILE, a GROUP or an EVENT.
"USER": refers to any person who accesses and browses the PLATFORM after having created an ACCOUNT.
"SPECTATOR": refers to any person who accesses and browses the PLATFORM after having created an ACCOUNT and who has not yet published any images.
ARTICLE 3. ACCEPTANCE OF GENERAL CONDITIONS
The use of the functions of the PLATFORM and the SERVICES implies acceptance of these T & Cs.
Thus, the USER undertakes to carefully read these T & Cs when accessing the PLATFORM and is invited to download them, print them and keep a copy.
It is specified that these T & Cs are referenced at the bottom of each page of the PLATFORM's website by means of a hypertext link and can thus be consulted at any time.
On the Application, these T & Cs are accessible from the USER's preferences, accessible via his menu.
ARTICLE 4. TECHNICAL SPECIFICATIONS
By using the PLATFORM, the USER acknowledges having the means and skills necessary to use the PLATFORM.
The equipment necessary for access and use of the PLATFORM are the responsibility of the USER, as are the telecommunications costs incurred by their use.
ARTICLE 5. ROLE OF THE OPERATOR
5.1. Intervention as a simple intermediary
The PLATFORM published by EION consists in particular of putting USERS in contact electronically with a purpose to sharing their CONTENT.
It is specified that these General Conditions of Use do not in any way confer on USERS the quality of employee, agent, agent or representative of EION.
5.2. Loyalty, Clarity and Transparency
As an online platform operator, EION acts in a neutral, clear and transparent manner.
EION has no capital link or any legal dependence with any of the USERS listed on the PLATFORM which would influence the ranking or referencing of the CONTENT.
The CONTENTS presented to Internet users on the PLATFORM are referenced as follows:
- When the USER opens the application, the EION STREAM is displayed. In this STREAM are referenced in an antecchronological manner the images of the USER, the images of USERS of which the USER is a fan and with whom he is a subscriber, the images selected by EION in the "Discover and explore eion" playlist and the images of playlists to which the user is subscribed.
- On the PROFILE of each USER, the CONTENTS published by said USERS are displayed antecchronologically.
- The USER can also access the various contents of USERS by searching by USER or by GROUP, via the search engine made available to them by EION.
- The USER can also perform an image search by keywords on the images of PRO USERS, via the search engine made available to them by EION.
- In addition, within the search engine, EION presents the USER with suggestions of PROFILES. The PROFILES suggested to the USER are selected by the ADMINISTRATORS according to their work, their diversity and their level of involvement within EION.
- The USER can also, via his history, access the last PROFILES visited, classified antecchronologically.
Apart from the case of EION suggestions presented in the search engine, THE USER is informed that EION does not favor any USER by presenting its CONTENTS as a priority.
If the number of unique monthly visitors to the PLATFORM is greater than five million unique visitors per month, EION will duistribute best practices.
5.3 Moderation
EION will moderate the CONTENT published on the PLATFORM on the basis of all the obligations described in these T & Cs and in particular the obligations listed in Article 8.1 hereof.
In the event that the CONTENT published by a USER contravenes one of the criteria mentioned above, EION reserves the right to :
- Delete the CONTENTS concerned;
- Suspend the USER'S ACCOUNT;
- Make the CONTENT and / or the USER invisible in the event of a dispute or dispute regarding its CONTENT, the time to allow the USER to respond and possibly correct the CONTENT. The USER made invisible can no longer be seen on the PLATFORM and can no longer have interactions with other USERS of the PLATFORM. He only has access to his own CONTENT.
In the case that a USER is the subject of an ACCOUNT suspension or if it is made invisible, the latter will be automatically disconnected from the PLATFORM.
When reconnecting to the PLATFORM, two situations may arise :
- If the USER has been made invisible: he will be informed by email of the breaches for which he is accused and will be invited to resolve them;
- If the USER's ACCOUNT has been suspended: he will be informed by email and will be invited to terminate his purchase via the preferences of his phone by pressing the "Manage subscriptions" button.
ARTICLE 6. CONDITIONS OF ACCESS AND REGISTRATION
The USER must create an ACCOUNT to be able to use the PLATFORM and benefit from the SERVICES described in Article 7 of these T & Cs.
Any USER wishing to have full access to all the free functions offered by the PLATFORM must first create an ACCOUNT.
Registration on the PLATFORM as a USER is free.
To create an ACCOUNT, the USER is invited to provide the following information :
- Name;
- First name;
- Type of ACCOUNT (individual or brand, company, celebrity);
- Nickname (the USER can choose to have his nickname become his username rather than his first and last name);
- Activity;
- E-mail address;
- Password;
- Gender;
- Age;
- Url EION;
The minimum age to register on the PLATFORM is 13 years old. Regarding minors under the age of 15, they must have the consent of their legal representative to register on the PLATFORM.
The USER wishing to create an ACCOUNT undertakes to provide EION with accurate, loyal and up-to-date data, which does not infringe, in any capacity whatsoever, the rights of third parties and to communicate to EION any update necessary data communicated during registration.
Finally, the USER must validate these T & Cs before finalizing their registration.
From the completion of the registration form, the USER will receive by email a code allowing him to validate his registration.
The USER will then have the status of SPECTATOR which will allow him to access the entire platform without restrictions.
A USER who visits the profile of a SPECTATOR, who has not yet published images, sees the stream of images liked by that SPECTATOR.
A USER can become a FAN of a SPECTATOR in which case he will receive a notification when that SPECTATOR starts posting images and these images have been verified by EION.
As soon as a SPECTATOR begins to publish one (1) image, he must publish a total of three (3) images so that EION can verify that these images comply with the content authorized / not authorized on the platform and as described in Article 8.1 below and in accordance with these T & Cs.
During this verification, the USER changes to the "Pending" status. His published images are not yet visible to other USERS.
Once the three (3) images published by USER and verified by EION, USER changes from SPECTATOR status to FREE status, and can post freely on EION. Its images then become visible to all USERS.
The USER receives a confirmation email indicating when their images have been verified.
The USER can create several ACCOUNTS. In any case, to be able to access another ACCOUNT, he must disconnect from the ACCOUNT to which he is connected on the PLATFORM.
The USER is fully responsible for the accuracy and updating of the data communicated as part of the opening and management of his ACCOUNT.
6.1. Subscription to the PRO subscription
The USER registered on the PLATFORM can subscribe to a monthly PRO subscription.
The USER must go to the "Become PRO" tab of the PLATFORM. It will then be sent to the App Store on their phone.
The amount of the PRO subscription is indicated on the PLATFORM and is charged by the operator operating the App Store from the USER's phone. The latter is required to go to the preferences of his phone, in the "Manage subscriptions" tab in the event of termination of the subscription in accordance with the procedure described in Article 6.3 hereof.
6.2. Management of IDENTIFIERS
The USER will be solely responsible for the use of his IDENTIFIERS or the actions made through his ACCOUNT.
In the event that a USER discloses or uses his IDENTIFIERS in a manner contrary to their intended purpose, EION may then terminate the ACCOUNT without notice or compensation.
In any case, EION can not be held responsible in the event of the usurpation of the identity of a USER. Any access and action carried out from the ACCOUNT of a USER will be presumed to be carried out by this USER, insofar as EION is not obligated and does not have the technical means enabling it to ensure the identity of the users. persons having access to the PLATFORM from an ACCOUNT.
Any loss, misappropriation or unauthorized use of a USER'S IDENTIFIERS and their consequences are the sole responsibility of the USER, the latter being required to notify EION, without delay, by e-mail sent to the following address : base@eion.io
6.2. Unsubscribe
The USER can close their ACCOUNT at any time by sending an email to the address: base@eion.io. EION will deactivate the ACCOUNT as soon as possible and send the USER an email confirming the closure of their ACCOUNT and the permanent deletion of all of their CONTENT on the PLATFORM.
For USERS who have subscribed to the PRO subscription, the latter is required to cancel the recurring payment for the subscription in the preferences menu of their phone. EION will send an email to the USER who has requested to unsubscribe, inviting them to cancel their purchase and providing them with a link to their phone preferences.
ARTICLE 7. SERVICES
EION offers free and paid services.
Article 7.1. Services offered free of charge to all USERS
Any USER who has created an ACCOUNT can access the PLATFORM free of charge, as well as its various functions.
Article 7.1.1 Publication of CONTENT
The USER can post CONTENT on the PLATFORM.
The USER is limited to one (1) publication every twenty-four (24) hours (without a PRO subscription).
In addition, the USER has access to the last hundred (100) images he has published (without a PRO subscription).
CONTENT in image form is always published with a title. By default, the title is the date the image was taken.
The USER can define for his image:
- A title;
- A description;
- A frame;
- Geolocation;
- A mask color.
The USER chooses to publish his CONTENT:
- In its STREAM;
- In a COLLECTION;
- In a private COLLECTION;
- In a GROUP ;
- In an EVENT.
The image can be published permanently or ephemeral according to a timeframe chosen by the USER.
Before any publication of an image, the USER is invited to guarantee that he is the author of the image and / or that he holds the distribution rights allowing him to publish said image.
In addition, the USER must indicate whether his image or the associated texts contain:
- Nudity;
- Violence or light violence;
- Innuendo of a sexual nature;
- Drug;
- Alcohol.
The CONTENTS published by the USER will be classified by the USER according to the following categories:
- Category 13 + (USERS between 13 and 15 years old): images or text containing light violence, sexual innuendos, drugs and alcohol.
- Category 16 + (USERS between 16 and 17 years old): images or text containing nudity or violence.
If any CONTENT posted by the USER falls into one of these age categories or published for all, EION reserves the right to blur the image by accompanying it with a warning message. The USER must then give his consent to be able to view said CONTENT.
The case where a user, negligently or deliberately, posts an inappropriate image (images or text containing mild violence, sexual innuendo, drugs and alcohol / images or text containing nudity or violence) without having taken care, when posting this image, to verify and define the age category (13+ or 16+), is grounds for immediate suspension of this user's account on eion.
Several publication formats are available:
- Simple image with an optional title and description:
The USER can post a simple image and add an optional title and description. The USER can edit the published image.
Before the publication of the CONTENT, the USER can select a publication duration and cause the image to disappear after a certain period of time.
- Collage:
Posting as a collage consists of overlaying a foreground with a background. The title of the resulting image is "Collage" and cannot be changed.
Before the publication of the CONTENT, the USER can select a duration of publication and cause the COLLAGE to disappear after a certain period of time.
- Collab:
USER adds half of an image and invites another USER to complete the other half. The title of the resulting image is "Collab" and cannot be changed.
Article 7.1.2. Search by search engine
The USER can, when looking for a GROUP, a USER, or a KEYWORD (eg: a search on the keyword: "Paris") use the search engine.
In such a case, the results corresponding to his search will be classified into several categories:
- EION: presents, in alphabetical order, the PROFILES corresponding to the search for the USER;
- EION: presents, in the case of a keyword search, the most recent images of PRO USERS whose title contains the KEYWORD, in the PRO tab and corresponding to the USER search;
- GROUPS / EVENTS: the GROUPS or EVENTS corresponding to the search for the USER are presented in alphabetical order.
Article 7.1.3. Interaction between USERS
7.1.3.1 Become a Fan
Each USER can become a fan of another USER by going to the home page of his PROFILE and clicking on "Become a fan", or via the menu.
The EION STREAM pre-chronologically presents the CONTENT of USERS of which the USER is a fan.
The USER may cease to be a fan of another USER at any time.
7.1.3.2 Send and receive Messages

7.1.3.3 Invitation
The USER can invite another USER TO:
- View an image;
- See a PROFILE;
- See a COLLECTION;
- Join a GROUP or an EVENT.
The invitation may relate to the CONTENT of the USER sending the invitation, or the CONTENT of another USER.
7.1.3.4. Likes
Each USER can like the CONTENT of other USERS by clicking on the icon represented by a heart. The like STREAM allows the USER on the one hand to see all the CONTENT he liked, and on the other hand, all the liked CONTENT of USERS of which the USER is a fan.
The USER can for each other USER see all the CONTENT that this other USER has liked.
Article 7.1.4 Becoming a member of a GROUP or EVENT
Each USER can become a member of a GROUP or an EVENT. The GROUPS STREAM regroups all the CONTENT published in the GROUPS or EVENTS to which the USER has joined.
A GROUP allows several USERS who have joined it, to publish CONTENT around a theme. The consent of the USER who created the GROUP is required to be able to access said GROUP.
An EVENT is a GROUP organized around an event and having a start date and an end date. USERS who have joined the EVENT may post CONTENT on this EVENT until its end date.
Article 7.1.5 Creation of COLLECTIONS
Each USER can create COLLECTIONS to store and organize his images according to his own criteria, which the USER can access through his menu.
COLLECTIONS can be viewed by all USERS. The USER can also choose to create one or more private COLLECTION (S). In this case, only the USER who created the private COLLECTION will be able to access it.
A visible COLLECTION can become private and vice versa.
The USER may add guests to their private COLLECTIONS to view or download the CONTENT of said COLLECTION.
Article 7.1.6 QR Codes
In order to facilitate the sharing of CONTENT on the PLATFORM, EION has a reader and a QR code generator.
By scanning a QR Code, the USER accesses the CONTENT from which the QR Code was created.
Article 7.1.7 Camera
USER can take photos from the EION application.
Article 7.1.8. Access to ACCOUNT preferences
By creating an ACCOUNT, the USER can modify his personal information in his preferences accessible from his menu and on his home.
The USER can modify:
- His about;
- His avatar;
- His address;
- His telephone;
- His job.
On his home, the USER will also be able to have an overview of his last 5 activities (the likes received by him or the USERS of which he is a fan, follow the invitations sent or received).
7.1.9 Access to the ACCOUNT menu
Via its menu, the USER can create and access their COLLECTIONS and private COLLECTIONS.
He will also be able to access GROUPS and EVENTS of which he is a member, and create new GROUPS or EVENTS.
7.1.10 Access to activities
The USER can have access to all of his latest activities (publication of his fans, integration of GROUPS or EVENTS, likes received, etc.).
7.1.11 Reporting CONTENT
Each USER can report to EION any CONTENT published by another USER.
EION will moderate said CONTENT under the conditions defined in Article 5.3 of these T & Cs.
When a USER reports CONTENT, said CONTENT is made invisible to that USER
Article 7.2. PRO subscription
The USER can take a PRO subscription under the conditions provided for in article 6.1.
Payment of the PRO subscription gives the USER access to the following SERVICES:
Article 7.2.1 Unlimited publication of CONTENT
The USER may publish CONTENT on the PLATFORM under the conditions detailed in Article 7.1.1 hereof, except in these provisions relating to the limit of CONTENT that may be published.
The USER can therefore publish CONTENT on the PLATFORM without limitation.
Article 7.2.2 Access to all published CONTENT
As part of the PRO subscription, the USER can access all the CONTENT he has published on the PLATFORM, regardless of the limit of 100 (one hundred) last images granted to USERS who have not subscribed to the PRO subscription.
Article 7.2.3 Creation of e-books
As part of the PRO subscription, USER can create e-books with more than 5 images.
ARTICLE 8. OBLIGATION OF THE PARTIES
8.1. Obligations of USERS
As part of the use of the PLATFORM, each USER undertakes not to undermine public order and to comply with the laws and regulations in force, to respect the rights of third parties and the provisions of these T & Cs.
Each USER has the obligation to:
- Behave in a fair and reasonable manner with regard to EION and third parties;
- Be honest and sincere in the information provided to EION and, where applicable to third-party USERS;
- Use the PLATFORM in accordance with its purpose as described in these T & Cs;
- Do not divert the purpose of the PLATFORM to commit crimes, misdemeanors or contraventions punishable by the Penal Code or any other law;
- Respect the privacy of third parties and the confidentiality of exchanges;
- Respect the intellectual property rights of EION relating to the elements of the PLATFORM and the intellectual property rights of other USERS;
- Do not seek to infringe, within the meaning of articles 323-1 and following of the Penal Code, the automated data processing systems implemented on the PLATFORM;
- Do not modify the information posted online by EION or by another USER;
- Do not use the PLATFORM to massively send unsolicited messages (advertising or other);
- Do not disseminate data having the effect of reducing, disrupting, slowing down or interrupting the normal functioning of the PLATFORM.
In compliance with the legal and regulatory provisions in force and in accordance with the french law of July 29, 1981 on freedom of the press, the USER undertakes not to disseminate any message or information:
- Constitutive of faulty denigration targeting EION or the USERS;
- Contrary to public order and good morals;
- Offensive, defamatory, racist, xenophobic, revisionist or damaging to the honor or reputation of others;
- Inciting discrimination, hatred of a person or a group of people because of their origin or their membership or their non-membership of an ethnic group, nation, race or religion;
- Threatening a person or a group of people;
- Of a pedophile nature;
- Pornographic in nature;
- Inciting to commit an offense, a crime or an act of terrorism or advocating war crimes or crimes against humanity;
- Inciting suicide;
- Allowing third parties to directly or indirectly obtain pirated software, software serial numbers, software allowing acts of hacking and intrusion into computer and telecommunications systems, viruses and other logic bombs and in general, any software or other tool making it possible to infringe the rights of others and the safety of persons and goods;
- Commercial (prospecting, soliciting, prostitution, etc.).
8.2. Obligations of EION
EION's general obligation is an obligation of means. It does not weigh on EION any obligation of result or reinforced means of any kind.
EION undertakes to use all means to ensure continuity of access and use of the PLATFORM 7 days a week, 24 hours a day.
EION, however, draws the attention of USERS to the fact that current Internet communication protocols do not make it possible to ensure the transmission of electronic exchanges (messages, documents, identity of the sender or recipient) with certainty and continuously.
Furthermore, as an online platform operator, EION undertakes to provide clear, transparent and fair information on the terms of its intervention, in particular in Article 5.2. hereof.
ARTICLE 9. RESPONSIBILITY
9.1. General principles
EION declines all responsibility, in particular:
- In the event that it is impossible to temporarily access the PLATFORM for technical maintenance operations or updating of published information. USERS acknowledge that EION cannot be held liable in the event of malfunctions or interruptions of said transmission networks;
- In the event of virus attacks, unlawful intrusion into an automated data processing system;
- In the event of abnormal use or illegal exploitation of the PLATFORM by a USER or a third party;
- Relating to the content of third-party websites to which hypertext links on the PLATFORM refer;
- In the event of non-compliance with these T & Cs attributable to USERS;
- In the event of delay or non-performance of its obligations, when the cause of the delay or non-performance is related to a case of force majeure as defined in Article 10 of these T & Cs;
- In the event of a foreign cause not attributable to EION;
In the event of abnormal use or unlawful exploitation of the PLATFORM, the USER is then solely responsible for damage caused to third parties and the consequences of any claims or actions that may result therefrom.
9.2. Disputes between USERS
EION draws the attention of USERS to the fact that any dispute arising between USERS must be dealt with between them.
In the event of a dispute with a USER, the other USER may contact EION Customer Service by sending an email to base@eion.io or a letter to eion, 5 rue Legouvé 75010 Paris.
EION will pass on the complaint to the USER concerned, who will be solely responsible for handling the dispute.
EION may only, where appropriate, intervene as a mediator.
ARTICLE 10. FORCE MAJEURE
EION cannot be held liable if the non-performance or delay in the performance of one of its obligations described in these T & Cs results from a case of force majeure.
There is force majeure in contractual matters when an event beyond the control of the debtor, which could not be reasonably foreseen at the time of the conclusion of the contract and the effects of which cannot be avoided by appropriate measures, prevents the execution of its obligation. by the debtor.
If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is final, the contract is automatically terminated and the parties are released from their obligations under the conditions provided for in articles 1351 and 1351-1 of the french Civil Code.
As such, EION cannot be held liable in particular in the event of an attack by hackers, unavailability of equipment, supplies, spare parts, personal equipment or others; and interruption, suspension, reduction or disturbances of electricity or other or any interruptions of electronic communications networks, as well as in the event of the occurrence of any circumstance or event outside the will of EION occurring after the conclusion of the T & Cs and preventing execution under normal conditions.
It is specified that, in such a situation, the USER cannot claim the payment of any compensation and cannot bring any recourse against EION.
In the event of any of the above events occurring, EION will endeavor to inform the USER as soon as possible.
ARTICLE 11. INTELLECTUAL PROPERTY
11.1 Ownership of the intellectual property rights of USERS
As part of the publication of CONTENT via the PLATFORM, USERS present images belonging to them or belonging to third parties and for which they hold the distribution rights.
Any USER uploading CONTENT on the PLATFORM guarantees that he has the right to make a representation of all intangible elements presented in the CONTENT.
In addition, the USER grants EION for the duration of the relationship between the PARTIES, a license relating to its reproduction right,
ON THE PLATFORM ONLY, in order to allow it to distribute its CONTENTS on the PLATFORM.
As part of the use of the SERVICES, the USER has the option of creating COLLAGE, or COMPOS. He can also create COLLABS with another USER.
In the context of COLLAGE and COMPOSITION, the USER, being the original, remains the owner of the intellectual property rights over his work created using the services of EION.
As part of the COLLABs, the two USERS who have collaborated for the production of a work are both owners.
Likewise, the USER owns the copyright to images taken using EION's camera. When a USER takes a photo with the camera provided by EION, a "copyright" notice is specified within the image metadata. This mention specifies the USER name.
If the image has a copyright within its metadata, the USER will be informed of this copyright when posting the image.
This copyright will be displayed when the user taps the button representing the copyright symbol.
This copyright will also be displayed as text above the image on the right of the screen.
If the copyright is absent when the USER publishes an image, because it is not filled in within the image metadata, the USER's name will be displayed at the bottom right of the image (without the copyright symbol © ).
EION expressly prohibits any USER from taking a screenshot of any CONTENT posted by another USER in order to reuse said CONTENT.
11.2 Ownership of the intellectual property rights of EION
The USER acknowledges the intellectual property rights of EION on the PLATFORM, its components and the related content and waives any challenge to these rights in any form whatsoever.
The brands, logos, slogans, graphics, photographs, animations, videos, software solutions and texts and any other content on the PLATFORM,
EXCEPT CONTENT PUBLISHED BY USERS, are the exclusive intellectual property of EION and may not be reproduced, used or represented without express authorization under penalty of legal proceedings.
Any representation or reproduction, in whole or in part, of the PLATFORM and its content, by any means whatsoever, without the express prior authorization of EION, is prohibited and will constitute an infringement punishable by articles L.335-2 and following and Articles L.713-1 and following of the french Code of Intellectual Property.
In particular, EION expressly prohibits:
- The extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the content of its database on another medium, by any means and in any form whatsoever;
- Reuse, by making available to the public all or a qualitatively or quantitatively substantial part of the content of the database, whatever the form;
- Reproduction, extraction or reuse, by any means, of content (photographs, description, etc.) published by EION or by a USER.
Acceptance of these T & Cs constitutes recognition by USERS of EION's intellectual property rights and a commitment to respect them.
EION grants a personal, non-exclusive and non-transferable license to USERS authorizing them to use the PLATFORM and the information it contains in accordance with these T & Cs.
Any other use of the PLATFORM and its content is excluded from the scope of this license and may not be carried out without the express prior authorization of EION.
ARTICLE 12. PROTECTION OF PERSONAL DATA
As part of the operation of the PLATFORM, EION may collect personal data.
These data are necessary for the management of the PLATFORM and the provision of the SERVICES. The data is kept confidentially by EION for the purposes of the contract, its execution and in compliance with the law.
As such, the USER is invited to consult the Privacy Policy, further down in this document, which will give him all the information relating to the protection of personal data, and the processing carried out via the PLATFORM.
In accordance with the french law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation known as GDPR), EION ensures the implementation of the rights of individuals concerned.

ARTICLE 14. VALIDITY OF THE T & Cs
If any of the stipulations of these T & Cs were to be declared void with regard to a legislative or regulatory provision in force and / or a court decision having the force of res judicata, it will be deemed unwritten but not will in no way affect the validity of the other clauses which will remain fully applicable.
Such a modification or decision does not in any way authorize USERS to disregard these T & Cs.
ARTICLE 15. MODIFICATION OF THE T & Cs
These T & Cs apply to any USER browsing the PLATFORM.
The T & Cs may be modified and updated by EION at any time, in particular to adapt to legislative or regulatory developments.
The applicable T & Cs are those in force at the time of browsing the PLATFORM.
USERS will be notified of any planned modification of these T & Cs.
ARTICLE 16. GENERAL PROVISIONS
The fact that one of the PARTIES has not required the application of any clause of these T & Cs, whether permanently or temporarily, may in no case be considered as a waiver of said clause.
In case of difficulty of interpretation between any of the titles appearing at the head of the clauses, and any of these, the titles will be declared non-existent.
ARTICLE 17. JURISDICTION AND APPLICABLE LAW
THESE T & Cs AS WELL AS THE RELATIONSHIP BETWEEN THE USER AND EION ARE GOVERNED BY FRENCH LAW.
In the event of a dispute arising between EION and a USER regarding the interpretation, execution or termination hereof, the PARTIES will endeavor to settle it amicably.
In such a case, the USER is first invited to contact the EION mediation service at the following address: eion, 5 rue Legouvé 75010 Paris.
If no agreement is reached, then an optional mediation procedure will be offered, conducted in a spirit of loyalty and good faith with a view to reaching an amicable agreement upon the occurrence of any conflict relating to this contract, including relating to its validity.
The PARTY wishing to implement the mediation process must first inform the other PARTY by registered letter with acknowledgment of receipt indicating the elements of the conflict.
As mediation is not compulsory, the USER or EION may withdraw from the process at any time.
In the event that mediation fails or is not considered, the dispute that may have given rise to mediation will be referred to the competent court.

OPERATOR: refers to EION, as the operator of the online platform.
PLATFORM: means the internet PLATFORM accessible at the address https://www.eion.io and the mobile application; the PLATFORM brings together all the web pages, services and functionalities offered to USERS.
DATA CONTROLLER: refers to the entity which, alone or jointly with another, determines the means and purposes of processing personal data.
SERVICES: refers to all the services offered by EION to USERS through the PLATFORM, and in particular connecting USERS for the production of CONTENT.
SUBCONTRACTOR: means the person processing personal data on behalf of the DATA CONTROLLER, who acts under the authority of the DATA CONTROLLER and on the instructions of the latter, in accordance with Article 28 of the GDPR.

T1 - Access to the PLATFORM, intermediation and provision of SERVICES: Personal data is kept for the duration of the contractual relationship with the OPERATOR and then stored for five (5) years for the purpose of proof.
